1. About these Terms

These Terms & Conditions (the "Terms") govern access to and use of the Crescript website, platform, and related services (the "Service").

By accessing or using the Service, creating an account, starting a free trial, or purchasing a subscription, the user agrees to these Terms.

3. Eligibility

The Service is intended only for persons aged 18 or older who have legal capacity to enter into a binding agreement.

If a user uses the Service on behalf of a company or organization, that user represents that they are authorized to bind that entity.

4. Account registration

To access certain features, users may need to create an account. Users must provide accurate, complete, and up-to-date information and keep login credentials secure.

Users are responsible for activities carried out through their account.

5. Service description

Crescript is a digital service that generates text scripts for social media and similar publishing formats, including use cases related to finance or stock-market-related content.

Users may submit text prompts and select parameters such as tone, duration, language, and other generation preferences. Crescript then returns a script based on those instructions, which may include timestamps or other structural elements.

Some features, limits, or options depend on the user’s subscription level.

6. Free trial, subscriptions, and renewal

Crescript may offer a free trial. Trial access may be limited in duration, functionality, output, or usage.

Paid plans are billed on a recurring monthly basis unless stated otherwise. Subscriptions renew automatically until cancelled.

Users may cancel renewal at any time before the next renewal date. Cancellation prevents future renewal but does not normally affect the current paid period already started, subject to mandatory legal rights.

7. Pricing, taxes, and billing

Prices are shown in Euro (EUR) unless stated otherwise.

Applicable taxes, including VAT where required, may be added in accordance with the rules applicable to a Spanish self-employed provider and the user’s location.

Payments are processed through Stripe. By purchasing a subscription, the user authorizes the relevant payment charges through the selected payment method.

8. Refunds and withdrawal rights

Refund requests are handled on a discretionary, case-by-case basis upon request, without prejudice to any mandatory consumer rights that may apply under applicable law.

Where the user is a consumer in the European Union or another jurisdiction with mandatory withdrawal rights, those rights apply to the extent required by law.

Where legally permitted, and where the user expressly requests immediate commencement of the digital service during the withdrawal period, the user may be asked to acknowledge that this may affect or remove the right of withdrawal once performance has begun or been completed, to the extent permitted by applicable law.

9. Acceptable use

Users may not use the Service:

  • for unlawful, fraudulent, or deceptive purposes;
  • to generate content outside the intended scope of Crescript;
  • to manipulate, interfere with, probe, overload, or abuse the Service or its infrastructure;
  • to infringe third-party rights, including intellectual property, confidentiality, privacy, or publicity rights;
  • to generate or facilitate illegal content, malicious content, harassment, threats, fraud, or deceptive financial claims;
  • to introduce malware, bots, scripts, or harmful code;
  • to reverse engineer, scrape, or systematically extract the Service except where expressly allowed by law and only to the extent such restriction is unenforceable.

Additional operational rules may be set out in the Acceptable Use Policy, which forms part of these Terms.

10. User content

Users retain their rights in the prompts, materials, and other content they submit to Crescript.

Users grant Crescript a non-exclusive, limited license to host, process, transmit, store, and display that content only as necessary to provide the Service, maintain history, ensure security, prevent abuse, conduct limited quality review, and meet legal obligations.

Users are responsible for ensuring that they have the necessary rights and permissions to submit the content they use with the Service.

11. Generated outputs

Subject to applicable law and these Terms, users may use generated outputs commercially while they have a valid subscription in force.

Crescript does not guarantee that outputs are accurate, complete, current, lawful for a particular use, or fit for publication without review.

Outputs may contain errors, omissions, inaccuracies, outdated information, or statements that are not suitable for a specific audience or legal environment.

The user is solely responsible for reviewing, editing, validating, and approving any output before publication, distribution, or business use.

12. No financial, legal, or professional advice

Crescript is a script-generation service. It is not an investment advisory service, broker, analyst, financial planner, legal adviser, tax adviser, or regulated professional service.

Any references to finance, markets, securities, or stock-related topics are generated as informational or creative script content only and may be inaccurate, incomplete, or outdated.

Users must not rely on Crescript outputs as financial, investment, legal, tax, or compliance advice.

13. Service quality and review

Crescript may carry out limited review of prompts and outputs, using human or automated means, for quality assurance, abuse detection, debugging, and verification of service performance.

Crescript does not use user prompts or outputs to train its own models.

14. Third-party providers

The Service may rely on third-party providers, including cloud, payment, analytics, security, email, or AI generation providers. Crescript is not responsible for outages, delays, or failures solely attributable to third-party providers beyond its reasonable control.

15. Intellectual property

Except for user content and user rights in generated outputs as described in these Terms, all rights in the Service, website, software, branding, interfaces, databases, documentation, and related materials belong to Crescript or its licensors.

No rights are granted except as expressly stated.

16. Availability

Crescript will use reasonable efforts to keep the Service available, but does not guarantee uninterrupted, secure, or error-free operation.

Access may be suspended or affected by maintenance, technical issues, provider failures, security events, legal requirements, or force majeure.

17. Suspension and termination

Crescript may suspend or terminate access immediately, in whole or in part, where reasonably necessary if:

  • the user breaches these Terms or the Acceptable Use Policy;
  • payment fails or remains overdue;
  • use of the Service creates legal, operational, or security risk; or
  • Crescript is required to do so by law.

Users may stop using the Service at any time and may request account deletion in accordance with the Privacy Policy.

18. Disclaimers

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis.

Crescript disclaims all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

Nothing in these Terms excludes rights that cannot be excluded under mandatory consumer law.

19. Limitation of liability

To the maximum extent permitted by law, Crescript shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profit, revenue, data, goodwill, or business opportunity.

To the maximum extent permitted by law, Crescript’s aggregate liability for claims arising out of or related to the Service shall not exceed the total amount paid by the user to Crescript during the 12 months preceding the event giving rise to the claim.

Nothing in these Terms limits liability where such limitation is prohibited by law.

20. Governing law and jurisdiction

These Terms are governed by the laws of Spain.

For business users, disputes shall be submitted to the courts of Girona, Spain, unless mandatory law provides otherwise.

For consumers, mandatory jurisdiction and consumer protection rules apply where required by law.

21. Changes to the Terms

Crescript may update these Terms from time to time. The updated version will be published on the website with the effective date.

Continued use of the Service after the effective date of the updated Terms constitutes acceptance of the updated Terms, unless mandatory law requires a different mechanism.
